Portera ORDINANCE NO. 9615 AN ORDINANCE TO AMEND THE ORDINANCE NO. 9402, ENCAPTIONED AS SET FORTH HEREIN, SO AS TO SUBSTITUTE CERTAIN CONDITIONS TO A REZONING OF PROPERTY LOCATED AT 408 FORREST AVENUE, BEING ON THE SOUTHEAST LINE OF FORREST AVENUE AT MANNING STREET. ______________________________ WHEREAS, on June 5, 1990, the Board of Commissioners of the City of Chattanooga, Tennessee, enacted Ordinance No. 9402 encaptioned, "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED IN THE 300 AND 400 BLOCKS OF FORREST AVENUE, BEING ON THE NORTHWEST LINE OF FORREST AVENUE AT KENT STREET AND THE NORTHEAST LINE OF FORREST AVENUE AT MANNING STREET FROM R-3 RESIDENTIAL ZONE TO R-4 SPECIAL ZONE, SUBJECT TO CERTAIN CONDITIONS."; and WHEREAS, the Planning Commission has studied the petition in relation to existing zoning and land use and potential patterns of development; and WHEREAS, the Planning Commission has recommended to the Mayor and City Council of the City of Chattanooga that certain conditions be substituted for those conditions set forth in said Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9402, encaptioned as set forth above, be and the same is hereby amended by deleting the conditions in Section 2 thereof in their entirety and substituting in lieu thereof the following conditions: 1. That the design of any additional building(s) shall be residential in architecture and in conformity with existing neighborhood structures. 2. Access to the existing building may continue to be by the existing driveway from Forrest Avenue. If any additional building(s) is added, any access for this additional building(s) shall be from Manning Street only. 3. Any sign shall be affixed to the building(s) on the premises. 4. No additional parking in excess of the forty (40) by fifty-four (54) foot concrete parking area for the existing building shall be located in the side yard. If additional parking is needed for the existing building, it must be in the rear of the property to the rear of the existing structure. If any additional building(s) is added, parking for such building(s) will be located in the rear of the property.
